Please read these Terms carefully before using Movo Africa.

Movo Africa is a technology platform that connects drivers already making an intercity journey with passengers travelling the same way, so they can share the trip and its costs.

Movo Africa is not a taxi, e-hailing or public transport operator, and does not itself provide transport. By creating an account or booking a seat, you accept these Terms in full.

Purpose and Scope

Movo Africa operates a digital platform, accessible through a mobile application and website (the “Platform”), that allows users to post intercity carpooling trips or to search for, book and pay for a seat on such trips.

The Platform may also allow users to send parcels on trips that are already taking place (the “Parcel Service”), as described in Clause 8.

The Platform is designed to connect a Driver travelling to a given destination on their own account with one or more Passengers travelling in the same direction, so that they may share the journey and its associated costs.

The sum contributed by a Passenger is a Cost Contribution towards the running costs of the trip — it is not a commercial fare, and driving on the Platform is not a taxi or for-hire transport business.

Movo Africa applies a fair-cost ceiling on Cost Contributions. A Driver may not use the Platform to make a profit from carrying Passengers or operate as a commercial transport service.

Definitions

For purposes of these Terms:

Account

The user account created to become a Member and access certain Services.

Driver

A Member who offers to carry one or more Passengers on a Trip they are already making in exchange for the Cost Contribution.

Passenger

A Member who has booked a Seat on a Driver's Trip, or the person on whose behalf a Member has booked a Seat.

Cost Contribution

The amount requested by the Driver and accepted by the Passenger as a contribution towards the travel costs of a Trip.

Platform

The Movo Africa mobile application, website and related services.

Trip

An intercity carpooling journey posted by a Driver on which Passengers may travel in exchange for a Cost Contribution.

Registration, Accounts and Verification

3.1 Eligibility

Use of the Platform is reserved for natural persons aged 18 or over. Registration by a minor is strictly prohibited.

3.2 Creating an Account

To create an Account, you must register with a Kenyan mobile number and confirm it by one-time password (OTP). The Platform currently supports Safaricom and Airtel lines and mobile-money payments through M-Pesa and Airtel Money.

You must provide your full name, profile photo and email address, keep your login credentials secure and maintain only one Account.

3.3 Identity Verification

Before making a first booking or offering a first Trip, Members must complete the applicable identity verification process.

Drivers are subject to additional verification including identity, driving licence, vehicle documentation, insurance, applicable roadworthiness requirements and payout details.

Posting Trips and Booking Seats

Posting a Trip

Verified Drivers may publish Trips showing the route, date, departure time, available Seats and pick-up and drop-off points. A maximum of four Passengers may be offered seats on a Trip.

Drivers must have a valid driving licence, appropriate authority to use the vehicle, valid insurance and applicable inspection documents. Every Seat offered must have a seat belt.

Booking a Seat

Verified Passengers may request one or more Seats. A booking is confirmed once the applicable Driver approval and successful payment requirements have been completed.

Cost Contributions, Fees and Payments

Service Fee

Movo Africa charges a Service Fee for use of the Platform. The applicable amount or rate will be displayed before a booking is confirmed.

Fair-Cost Ceiling

Cost Contributions are subject to a fair-cost ceiling designed to allow Drivers to recover a fair share of Trip running costs without profiting from carrying Passengers.

Payment and Settlement

Passenger payments are collected into the Movo Africa Float and held until the Trip is completed and confirmed. Funds are then released to the Driver's verified payout number, subject to any applicable hold, dispute or review.

Payments are processed through M-Pesa and Airtel Money.

Cancellations, Refunds and Disputes

Cancellation and refund outcomes depend on who cancels and when the cancellation occurs, as displayed on the Platform at the time of booking.

Where a Driver cancels a confirmed Trip or fails to make the Trip as described, the Passenger is generally refunded the applicable Cost Contribution held in the Float.

Members may raise disputes with Movo Africa support. We may review booking records, payment status and information supplied by the parties in administering funds held in the Float.

Trust, Safety and Conduct

Members must treat each other with respect, provide accurate information and comply with applicable road-safety and traffic laws.

MOVO safety features may include identity and document verification, ratings and reviews, live GPS trip sharing, an SOS/panic function and a women-preferred ride option.

Parcel Service

Where available, the Platform may allow Members to send parcels on Trips that Drivers are already making.

Senders are responsible for ensuring parcels are lawful, properly packaged and accurately described. Prohibited items must never be sent.

Movo Africa acts only as an intermediary and payment facilitator. It does not itself carry, handle or insure parcels.

Your Obligations and Member Content

Members must use the Platform lawfully, provide accurate information, maintain only one Account and must not circumvent the fair-cost ceiling or payment system.

Members must not use MOVO to operate a commercial transport or courier business.

Role of Movo Africa

Movo Africa provides an intermediary technology platform. We are not a transport operator, taxi service, e-hailing service, carrier or courier, and we do not employ Drivers.

We do not own or operate the vehicles used for Trips. The arrangement for a Trip or parcel carriage is between the Members concerned.

Fraud Prevention

We operate controls designed to detect and prevent fraud, including verification checks, payout name matching, unusual activity monitoring and settlement holds.

Where fraudulent, unlawful or abusive activity is reasonably suspected, we may withhold funds, suspend an Account, reverse a transaction and report the matter to relevant authorities.

Data Protection and Privacy

Movo Africa processes personal data in accordance with the Data Protection Act, 2019 and our Privacy Policy.

Information processed may include identity documents, licences, contact information and location data during Trips.

Please read our Privacy Policy for further information about how personal data is handled.

Liability

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited under Kenyan law.

Subject to applicable law, Movo Africa acts only as an intermediary and is not responsible for the acts, omissions, conduct, roadworthiness, driving, punctuality or honesty of Members, the condition of vehicles, or Trips being delayed or cancelled.

Suspension, Termination and Changes

You may close your Account at any time. We may suspend or terminate access where these Terms are breached or where required by law.

These Terms may be updated from time to time. Where changes are material, Members will be notified through the Platform.

Governing Law and Disputes

These Terms are governed by the laws of the Republic of Kenya.

Disputes should first be addressed through good-faith discussion. If unresolved, they may be referred to mediation and subsequently to the courts of Kenya.
